Terms and conditions

Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

1. Additional agreement: an agreement whereby the consumer acquires products, digital content and/or services in connection with a distance contract, and these are supplied by BYLIMA or by a third party on the basis of an agreement with BYLIMA.

2. Cooling-off period: the period within which the consumer may exercise the right of withdrawal.

3. Consumer: the natural person who is not acting for purposes related to their trade, business, craft or profession.

4. Day: calendar day.

5. Distance contract: an agreement concluded between BYLIMA and the consumer within the framework of an organised system for distance selling, whereby exclusive or joint use is made of one or more means of distance communication.

6. Right of withdrawal: the consumer’s right to withdraw from the distance contract within the cooling-off period.

Article 3 – Applicability

1. These Terms and Conditions apply to every offer made by BYLIMA and to every distance contract concluded between BYLIMA and the consumer.

2. Before the distance contract is concluded, the text of these Terms and Conditions will be made available to the consumer electronically in such a way that it can be easily stored on a durable data carrier.

3. If specific product or service conditions apply in addition to these Terms and Conditions, the consumer may always rely on the provision that is most favourable to them in the event of conflicting conditions.

Article 4 – The Offer

1. If an offer has a limited period of validity or is subject to conditions, this will be expressly stated in the offer.

2. All product descriptions, images and specifications are provided as accurately as possible. Minor deviations in colour or appearance may occur due to screen settings or photography.

3. Obvious errors or mistakes in the offer (such as pricing or typographical errors) do not bind BYLIMA.

Article 5 – The Agreement

1. The agreement is concluded at the moment the consumer accepts the offer and fulfils the conditions stated therein.

2. After placing an order, the consumer will receive an order confirmation by email.

3. BYLIMA reserves the right to refuse or cancel an order if there are reasonable grounds to do so, such as suspected fraud or incorrect pricing.

Article 6 – Right of Withdrawal

1. The consumer has the right to withdraw from the agreement within 14 days without giving any reason.

2. The cooling-off period starts on the day after the consumer receives the product.

3. To exercise the right of withdrawal, the consumer must notify BYLIMA within the cooling- off period via an unambiguous statement.

Article 7 – Obligations of the Consumer During the Cooling-off Period

1. During the cooling-off period, the consumer shall handle the product and packaging with care.

2. The consumer is only liable for diminished value of the product resulting from handling beyond what is necessary to establish the nature and characteristics of the product.

Article 8 – Exercise of the Right of Withdrawal and Costs

1. If the consumer exercises the right of withdrawal, the product must be returned within 14 days after notification.

2. The consumer bears the direct costs of returning the product, unless stated otherwise.

3. Returned items must be unworn, unused and in original condition.

Article 9 – Obligations of BYLIMA in the Event of Withdrawal

1. BYLIMA will refund all payments received from the consumer within 14 days after receipt of the returned product.

2. Refunds will be made using the same payment method used by the consumer, unless otherwise agreed.

Article 10 – Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

Products made to the consumer’s specifications or clearly personalised.

Sealed products that are not suitable for return for hygiene reasons once unsealed.

Article 11 – Prices

1. All prices stated are inclusive of VAT, unless stated otherwise.

2. BYLIMA reserves the right to change prices at any time. Price changes do not affect orders already placed.

Article 12 – Conformity and Warranty

1. BYLIMA guarantees that the products comply with the agreement and applicable legal requirements.

2. Any additional warranty does not limit the consumer’s statutory rights.

Article 13 – Delivery and Execution

  1. Orders are processed with due care and delivered to the address provided by the consumer.
  2. Delivery times stated are indicative. Delays do not automatically entitle the consumer to compensation.
  3. The risk of damage or loss passes to the consumer upon delivery.

Article 14 – Payment

1. Payment must be completed using the payment methods offered in the webshop.

2. BYLIMA may suspend or cancel an order if payment is not completed successfully.

Article 15 – Complaints Procedure

1. Complaints must be submitted to BYLIMA within a reasonable time after discovery.

2. BYLIMA will respond to complaints within 14 days.

Article 16 – Liability

1. BYLIMA is not liable for indirect or consequential damages, unless mandatory law provides otherwise.

2. Any liability is limited to the amount paid for the relevant order.

Article 17 – Force Majeure

BYLIMA is not liable for failure to fulfil obligations due to circumstances beyond its reasonable control, including but not limited to strikes, transport disruptions or governmental measures.

Article 18 – Governing Law and Disputes

1. These Terms and Conditions are governed exclusively by Dutch law.

2. Disputes shall be submitted to the competent court in the Netherlands.

Article 19 – Amendments

BYLIMA reserves the right to amend these Terms and Conditions at any time. The most recent version will always be available on the website.
